Terms and conditions for using our services

1. Scope & Contracting

1.1 These GTC apply to all membership and subscription plans, classes, events and ancillary services offered by the Assoc. Hwalmoodo Switzerland also referred to as HMD Basel.

1.2 Memberships and subscriptions together form the basis of participation in club activities. They include access to classes, belt tests, and related events as described on the club website.

1.3 Agreements are concluded upon your registration and payment of the applicable membership fee and/or subscription, in accordance with the pricing published on our website.

1.4 The detailed internal regulations of the club are part of the contract. By registering, you acknowledge and accept those regulations. (See our internal regulations for details.)

2. Membership & Subscription Plans

2.1 Members may subscribe to different class plans (e.g., monthly, yearly) and student‑discounted plans. The applicable prices are those shown on the club website.

2.2 A one‑time annual membership fee applies in addition to the subscription plan.

2.3 Membership and subscriptions begin when payment is completed and continue for the agreed term. Unless otherwise specified, subscriptions renew automatically for the same term if not cancelled in line with clause 4.

3. Introductory Offers & Payment Methods

3.1 Introductory offers (e.g., reduced price for first month) may be available. Terms of the offer will be published and apply only if you meet the conditions stated.

3.2 Accepted payment methods include those specified on our website or during the checkout process. Membership fees and subscriptions must be paid by the due date. Access may be suspended for unpaid amounts.

4. Cancellation, Extension & Adjustments

4.1 A membership and/or subscription may be cancelled by you in accordance with the notice period stipulated in your plan. Cancellation does not entitle you to a refund for the remaining subscription or membership period, except as provided in section 8.1 regarding non-acceptance of amendments. For example, cancelling a yearly subscription after six months does not grant a refund for the remaining six months; the subscription remains active until the end of the paid period and will then terminate automatically. After the cancellation date, access to classes will cease and automatic renewal will end.

4.2 The club may suspend or terminate membership or subscription immediately in case of serious breach of internal regulations, misconduct, or non‑payment. At the club’s discretion, a pro-rata refund for the remaining subscription period may be granted.

4.3 If classes are unavailable due to holiday or facility closure (e.g., August break), the club may offer to extend the current subscription term or adjust the next billing date. Details will be communicated to members in advance.

5. Class Participation & Conduct

5.1 Members must follow the internal regulations e.g. attend classes punctually, use appropriate equipment, respect instructors and fellow members, and adhere to safety rules.

5.2 The club reserves the right to remove or refuse participation of any member who behaves in a manner that endangers safety or disturbs the training environment.

6. Additional Services & Equipment Sales

6.1 Apart from subscriptions, the club offers one‑off services (e.g., camps, exams, merchandise) which are billed separately and subject to terms published on our website or communicated via chat or verbally.

6.2 Equipment sales (e.g., uniforms, protective gear) are subject to sales terms applied by the original reseller (e.g. payment in advance, no returns unless defective).

7. Liability & Insurance

7.1 Training in combat sports carries inherent risk. Members train at their own risk and are responsible for ensuring they have adequate accident and health insurance.

7.2 The club’s liability is limited to damages caused by intentional misconduct of its instructors or staff. The club is not liable for theft, loss of personal items, or indirect damages.

8. Amendments & Notices

8.1 The club may amend these GTC or the internal regulations by giving written or electronic notice to members with 10 days notice. If a member does not accept the amendments and chooses to terminate their subscription, a pro-rata refund for the remaining subscription period will be granted, excluding membership fees. Continued use of the membership after the effective date constitutes acceptance of the amendments.

8.2 Notices, invoices and other communications will be sent to the email address provided upon registration.

9. Data Protection & Privacy

9.1 Our data privacy policy is available on our web site (link in the footer section).

10. Applicable Law & Jurisdiction

10.1 These GTC and all membership agreements are governed by Swiss law.

10.2 Disputes shall be submitted to the competent court in Basel, unless otherwise agreed.
